TERMS & CONDITIONS
Throughout this document, the words “us”, “we”, “our” refer to us, or our service as is appropriate in the context of the use of the words “you” and “your” refer to you, the person who is being presented with this document for your agreement. Access to and use of this app and the products and services available through this app are subject to the following terms, conditions and notices (the “Terms of Service” or “ToS”). By using the products and services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. We reserves the right to make changes to the app, related polices and agreements, the privacy policy and this ToS at any time. You are advised to check the app as often as possible to check for updates or changes to the said policies and agreements, the privacy policy and the ToS. If there is any inconsistency between the English and Chinese versions of these Terms & Conditions and the Privacy Policy below (unless otherwise indicated), the English version shall prevail.
As your Service provider, we respects your legal rights of privacy when collecting, storing, using and transmitting Personal Information (as defined below) and this Privacy Policy explains our privacy practices. It is our policy and obligation to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the laws of Hong Kong). In doing so, we will ensure compliance by our Associates to the strictest standard of security and confidentiality.
Please read the following carefully to understand our policy and practices regarding how your Personal Information will be treated. This Privacy Policy applies to all registered and unregistered Users of the Sites and may from time to time be revised, or otherwise changed where necessary.
Words or terms used in this Privacy Policy which are not specifically defined in this Privacy Policy have the meaning given to them in the Agreement (as defined below).
By being one of our Users or visitors to our Sites you agree to be bound by all the terms and conditions set out in this Privacy Policy and THAT YOU GIVE US YOUR CONSENT to collect, use and disclose such Personal Information. If you do not accept the terms of this Privacy Policy or disagree with any subsequent amendments, changes, or updates we made, you MUST NOT access the Sites and not use any Service provided by us. You hereby agree your only recourse in this case is to cease and desist from further use of the Service.
DEFINITIONS AND INTREPRETATIONS
The following shall have the meanings described herein:
(a) “Agreement” means the user agreement entered between us as the provider of the Service on the one part and you as the User on the other made effective upon your continued use of the Sites and/or Service.
(b) “Account” means an established relationship between the User and the network of information service provided by us including the username and password created by the User at his own initiative or provided by us and accepted by us for the purpose to enable the User to gain access to the Service provided by us.
(c) “Associates” means each and every one of our respective co-conspirators, partners and friends.
(d) “Internet” means a global computer network through which the almost-instant delivery of data or files occurs between connected computers.
(e) “Minor” means a person under the age of 18 (or the age that a person is permitted to enter into a contractual relationship under applicable law at your jurisdiction).
(f) “Non-Personal Information” means information that does not identify you as an individual as more stipulated in Clause 3.7.
(g) “Parent” or “Legal Guardian” means the person who has the legal authority (and the corresponding duty) to care for the person and property interest of a User who is a Minor.
(h) “Person” includes an individual, association, partnership, corporation, other body corporate, trust, and any form of legal organisation or entity.
(i) “Personal Information” means information about an identifiable individual, business, organisation or other entity, but does not include the name, title, business address, or telephone number of an employee and/or associate, partners of a business, organisation or other entity.
(j) “Privacy Policy” means this policy.
(k) “Service” means any of the services, functions, or features offered on the Sites provided by us for online collaboration and/or management including but not limited to point-of-sales systems, office automation systems and human resources management systems. Service may also be equivalent to “Project”.
(l) “Site(s)” means the website(s) including but not limited to (www.enlcy.com, or eventable-e30d5.web.app.com) or any other website (s) and sub-links owned and operated by us.
(m) “Users” means those individuals, employees, contractors and end users, as applicable, authorized by you or on your behalf to use the Service in accordance with the Agreement.
The headings and sub-headings in this Privacy Policy are for ease of reference only and are not to be taken into account in the construction or interpretation of any provision or provisions to which they refer. Unless otherwise specified in this Privacy Policy, words importing the singular include the plural and vice versa and words importing gender include all genders.
1.0 COLLECTION OF PERSONAL INFORMATION
1.1 The types of information collected by us include Personal Information and Non-Personal Information.
1.2 We may also receive, collect and store any Personal Information including but not limited to useless personal and/or latest gossip you provide to us when you or your group, collective or business:
(a) enquire of or make an application for Service;
(b) register to use and/or use any Service;
(c) upload and/or store information with us using the Service; or
(d) when you communicate with us through e-mail, SMS, a website or portal, or the telephone or other electronic means.
2.0 DISCLOSURE OF INFORMATION
2.1 We will never sell, share or mine your Personal Information with strategic partners, third parties or service providers.
3.0 YOUR PERSONAL INFORMATION
3.1 You are free to decide whether to provide, edit or remove your Personal Information disclosed in the Service. Except your username, you are free to amend your Personal Information which have been submitted to us and the profile information of the Account so long as those Personal Information are true and accurate. The action can be performed directly on your profile in the App.
3.2 You may opt out of receiving direct communication materials from us by following the instructions provided in such communiqué. Should you decide to opt out from receiving such materials, we may still send you non-promotional communications, such as those about the Account, previous purchases, our ongoing relations or change in operation, etc.
3.3 In accordance with the statutory requirements, we will honour your request not to use your Personal Information for the purposes of direct marketing.
4.0 USE OF PERSONAL INFORMATION
4.1 We collect Personal Information that you and your co-conspirators provide directly to us.
4.2 The ways of which we may use your Personal Information, once collected, may include but not limited to the followings:
(a) to keep you posted on our latest announcements, software updates, and upcoming events.
(b) to help us create, develop, operate, deliver, and improve our work and products, Service and content, and for loss prevention and anti-fraud purposes.
(c) to verify identity, assist with identification of Users, and to determine appropriate Service.
(d) to send important notices, such as communications about purchases and changes to our terms, conditions and policies.
(e) for our internal purposes, such as auditing, data analysis, gossip-mongering and research to improve our products, Service, and customer communications.
4.3 We may review the Personal Information from time to time to identify problems and solve disputes, and to identify Users who use multiple user identifications, codenames or aliases. We may compare and review your Personal Information for errors, omissions and accuracy.
5.0 SECURITY OF INFORMATION POLICY
5.1 We take the security of your Personal Information very seriously. We use reasonable administrative, technical, personnel and physical measures to safeguard Personal Information in our possession against loss, theft and unauthorized use, disclosure or modification. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
5.2 We will not be responsible for any loss, misuse, modification or unavailability of your Personal Information, or for any damages you may suffer as a result of the loss, misuse, modification or unavailability of your Personal Information, except to the extent that such loss, misuse, modification or unavailability is caused by our gross negligence or willful misconduct.
6.0 GUIDELINES ON AI
6.1 We may use AI to analyze your photos and provide you with personalized recommendations and insights. By using the Service, you consent to the use of AI for these purposes.
6.2 The AI analysis is based on the data you provide and may include information about your preferences, habits, and other relevant factors. We will not store and share this data with third parties without your consent, except as required by law or as necessary to provide the Service.
6.3 You can opt out of AI analysis at any time by adjusting your settings in the App.
6.4 Any AI-generated content is for informational purposes only and should not be considered as professional advice. We do not guarantee the accuracy or completeness of AI-generated content and are not liable for any decisions made based on such content.
6.5 Inappropriate content detected by AI will be flagged and may result in the removal of the content from the Service. Please note that used tokens will not be returned. We reserve the right to take appropriate action against users who repeatedly analyze inappropriate content, including suspension or termination of their accounts.\n6.6 We reserve the right to modify or discontinue the AI features at any time without prior notice.
7.0 STANDARD EXCHANGE POLICY
7.1 All products redeemed cannot be returned or exchanged under these Terms. Exceptions for exchange will be allowed for defective products only. Refund will be allowed if the product is out of stock. If you believe that your product is defective, please contact us. If we determines, in its sole discretion, that the product is defective, you will be eligible to exchange your product. Apple reserves the right to test your defective products.
To send back a product eligible for exchange, simply follow the instruction and send back your product with the original receipt (or gift receipt) and original packaging within 7 days of the date you receive the product.
8.0 CHANGE OF THIS PRIVACY POLICY
8.1 We may amend this Privacy Policy at any time by e-mail, or via posting the amended Privacy Policy on the Sites. All amended Privacy Policy shall automatically be effective [15] days after the posting day of such amended Privacy Policy. Your continued use of the Service after the effective date of such amended terms and/or conditions constitutes your acceptance of the amended Privacy Policy.
